A patent lawsuit has just ended, and sunshine lighting is facing transnational patent lawsuits again. Reporters exclusively learned that a company called Archipelago Lighting Inc (hereinafter referred to as ALI) was formally charged with sunshine in October 13, 2016 in the name of "plagiarism, fraud and unfair competition" in the US time. At present, the transnational lawsuit has been accepted by the central court of California. According to the indictment, ALI believes that the Kichler brand LED product supplied by sunshine for Lloyd's products is suspected of counterfeiting the outer package design of ALI, and the after sale telephone number is printed as the after sale telephone number which was originally belonged to ALI. Zhao Fanghua, director of sunshine lighting, responded that some of the products had printed wrong numbers after sale, but the question of patent ownership of product packaging is still open to question. After the sale of the telephone, the wrong public information showed that Lloyd's was the second largest chain of home furnishings in the United States, and Kichler was a brand dealer in Lloyds's sales lamps. ALI and sun lighting have successively agreed to supply Kichler products to Lloyds. ALI said that since August this year, consumers have been receiving calls, reflecting that the Kichler brand LED product produced by ALI is touched with "crisp" feeling after being switched on, or the product can not be used normally. Victor Deng, head of ALI, said that ALI had a trademark licensing agreement with Kichler before and designed a product package for an order, but the agreement was halted, so there was no ALI related products entering the market. Victor Deng introduced that ALI subsequently discovered that the LED products of consumers were producers of sunlight, while the aftermarket phones were printed on ALI's after sales calls. "Yes, the number is printed wrong. I asked later that it was wrong, ALI." Zhao Fanghua said that a group of products in sunshine production, because the staff did not pay attention to the number of after-sale telephone, led to the above products supplied to Lloyds. However, after discovering the problem, sunshine lighting has modified the after service telephone. "But the front is out." In August 25th, ALI issued a lawyer's letter calling for all sunshine products to be sold in the United States to sell the Kichler brand LED products with the ALI after sale telephone numbers sold in the United States. The "daily economic news" reporter has asked for confirmation from Lloyd's side, but as of press release, no reply has been received. Victor Deng said that he had reflected to Lao Shi and Kichler about the above two problems, but the person in charge of the purchase told him that he did not know the wrong number of the telephone number. He said that the sunshine illumination told Lloyds that the after sale telephone number printed on the product was purchased from ALI. Zhao Fanghua is not very clear about this response in terms of specific business matters. This is a statement after ALI exchanged with Lao and Kichler, but it is not clear how they communicate. Victor Deng said that in order to prevent ALI from carrying the corresponding "burden", it decided to sue sunshine lighting and its subsidiaries in the United States, Dallas and other three companies. Victor Deng said that the outer packaging of the product was designed by ALI. In August 30th, Wang Junwei, a lawyer for sunshine lighting, replied in his lawyer's letter that sun lighting production was supplied to Lawrence's Kichler brand LED product, which was authorized by Kichler trademark. The outer packaging was designed by a company specializing in product packaging design, and it was finally verified by Kichler. Kichler responsible person said, there are more than 50 suppliers of Kichler, and the lawsuit dispute between ALI and sun lighting is not known, so the reporter contacted Kichler's legal personnel. However, reporters waited for nearly a week. Up to the press release, no reply was received from Kichler forensic staff. Zhao Fanghua said that the total amount of supply involved in this lawsuit is not large, and the sales revenue realized by sunshine lighting and Lloyds's business is estimated at around 30 million yuan. Zhao Fanghua also believes that sunshine lighting is mainly made in foreign countries, and litigation has little impact on the enterprise itself. The prosecution will not affect the cooperation between sunshine lighting and Kichler and Lloyds. As the first private listed company in the domestic lighting industry, the contribution of overseas market to its performance is very important. According to the semi annual report 2016, the main market share of sunshine lighting is concentrated in Europe and the United States, of which North America's operating income is 473 million yuan, accounting for 22%. Zhao Fanghua also said that the current sunshine lighting subsidiary in the United States has received ALI litigation documents, and the company headquarters because of the time lag relationship, has not yet received.
